However, in light of a recent ruling by the National Labor Relations Board (NLRB), we strongly recommend that every organization, regardless of their usual update schedule, take a close look at their policies.
Recent developments from the NLRB, particularly the Stericycle case ruling, have significant implications for employer policies. This is noteworthy for private-sector employers across the country, as it pertains to the majority of businesses governed by the National Labor Relations Act (NLRA).
Here’s the essence of the matter: Your company’s policies are now subject to closer examination. If there’s a possibility that an employee could perceive a policy as coercive and it might deter them from exercising their NLRA rights, it’s a red flag. Most importantly, the original intent behind these policies doesn’t hold as much weight as how an employee in that situation might reasonably interpret them.
Given the ongoing uncertainty regarding the interpretation of these standards, it’s advisable for companies to proactively assess and, if necessary, adjust their policies. Some work rules that may require updates include rules around social media, criticism of the company’s management or products, civility in the workplace, confidentiality of investigations or complaints, and the list goes on.
