Effective July 28, 2019, employers with 15 or more employees in Washington State can no longer ask an applicant about their current or prior salary information when interviewing for an open position. Washington law makers have followed in the footsteps of California by also requiring pay scale information to be made available if an applicant or internal candidate asks for it.
The new law grants employers the option to confirm a candidate’s salary if it was voluntarily divulged in the interview process or after a job offer has been made. The employer must also be able to provide a salary range or have pay information set before the position is posted.
Non-compliance with this new law could result in an employer being held responsible to pay damages, interest and reasonable attorney’s fees. For more information, see RCW 49.58.060 and RCW 49.58.070 for more information or the full law here.
